 Detroit Bankruptcy Lawyers

Detroit, Michigan is the industrial and cultural heart of Michigan, the largest city in the state, and the city has seen its share of challenges. However, Detroit residents are a proud community of homeowners, business-owners, artists, educators, students, and others, all doing their best for their homes, their families, and their city. Without Detroit, there would be no “Michigan,” and The Hilla Law Firm aims to assist Detroiters out of debt-related difficulties through Chapter 7 and Chapter 13 bankruptcy.

Bankruptcy is not an end or a failure; it presents the possibility of starting over, of a fresh start. It can make a home easier to afford, easier to maintain, or easier to walk away from, depending upon what your personal goals are.

What Can a Bankruptcy Filed with a Detroit Bankruptcy Lawyer Do for You?

Different Types of Bankruptcies

Chapter 7 Bankruptcy in Detroit

Chapter 7 bankruptcy is a “liquidation” bankruptcy, allowing the complete discharge of debt with the force of Federal law behind it, allowing  you to leave the past behind you and make a fresh start. Discharge of debt in Chapter 7 bankruptcy will require you to repay $0 of the debt, cost you 0% interest, and will permanently prevent your creditors from harassing you.

Chapter 7 bankruptcy is also an excellent means of safely walking away from distressed or underwater real estate that you no longer wish to retain, without the fear of a future foreclosure deficiency judgment or tax liability tailing you for years into the future as can happen in a foreclosure outside of bankruptcy or when you short sell a home.

Chapter 13 Bankruptcy in Detroit

Chapter 13 bankruptcy is a “reorganization” bankruptcy rather than a complete liquidation of debt as in a Chapter 7. A Chapter 13 is a payment plan in which you repay some of what you owe to your creditors, but only what you can afford to pay after your household budget is taken into consideration. You pay something back, then, at the end, the balance not paid is totally discharged the same as it is in a Chapter 7.

In a Chapter 13, however, you can save a house from foreclosure, get rid of a second mortgage, repay at 0% interest non-dischargeable debt like child support or income tax arrears, and do a few other things that you can’t do in a Chapter 7.

Michigan Bankruptcy Rates

Chapter 7 Bankruptcy Rates in Detroit, Michigan

In most cases, we charge a “flat-fee” for Chapter 7 bankruptcies tailored to your individual circumstances. Our lowest Chapter 7 flat-fee is market consistent for the Detroit area, but the fee may be higher in an individual case if it offers a higher level of complexity, involving issues of corporation ownership, tax debt to be discharged, an ongoing divorce, significant non-exemptible assets, multiple real estate properties, and other issues.

Chapter 13 Bankruptcy Rates in Detroit, Michigan

Rates for Chapter 13 bankruptcies are not billed as “flat-fees” the way that Chapter 7 bankruptcies are. For Chapter 13 bankruptcies, we bill into your Chapter 13 payment plan, and the Bankruptcy Court pays our fees for us out of your Chapter 13 plan payments.
