Different Types of Bankruptcies
Chapter 7 Bankruptcy
A Chapter 7 bankruptcy is the form of personal bankruptcy sometimes called a “straight” or “liquidation” bankruptcy. This is because a Chapter 7 accomplishes one very straightforward outcome: the liquidation of 100% of your dischargeable debt and the cessation of all collection activities, including garnishment, lawsuits, foreclosure, repossession or seizure of vehicles, and more.
Although there are some forms of debt that can’t be discharged by a Chapter 7 bankruptcy, Chapter 7 will otherwise allow you to walk away from unmanageable debt without the need to repay any of it and without the need to fear ongoing collections attempts by your creditors or even taxable liability a result of the discharge of the debt.
Chapter 13 Bankruptcy
Chapter 13 bankruptcy is a “payment plan” or “reorganization” bankruptcy in which you repay some of what you owe to your creditors accordingly to your ability to pay (rather than being required to pay what creditors tell you must be paid outside of bankruptcy). It is not a complete liquidation of debt as in a Chapter 7, although, in many cases, nearly 100% of dischargeable debt may still be discharged, depending upon your income and expenses.
A Chapter 13 is, basically, a payment plan enforced by the Federal Bankruptcy Court upon all of your creditors, whether the debt is a “dischargeable” debt like a credit card or “non-dischargeable” debt like a child support arrearage or recent income taxes owed. It is a myth that you must repay 100% of what you owe through a Chapter 13 bankruptcy.
Michigan Bankruptcy Rates
Chapter 7 Bankruptcy Rates for Dearborn Heights, Michigan
The Hilla Law Firm charges a “flat-fee” for Chapter 7 bankruptcies tailored to your individual circumstances. Our lowest Chapter 7 flat-fee is market consistent for the Detroit area, but the fee may be higher in an individual case if it offers a higher level of complexity, involving issues of corporation ownership, tax debt to be discharged, an ongoing divorce, significant non-exemptible assets, multiple real estate properties, and other issues.
Chapter 13 Bankruptcy Rates for Dearborn Heights, Michigan
Our rates for Chapter 13 bankruptcies are not billed as “flat-fees” the way that Chapter 7 bankruptcies are. For Chapter 13 bankruptcies, The Hilla Law Firm bills hourly according to the number of hours required for the cases at Attorney John M. Hilla’s current hourly rate, which is favorably affordable in comparison with many other bankruptcy attorneys in the Detroit Metro area.
For Chapter 13 bankruptcies, although we may require a small retainer, it is usually less than you would pay us before filing for a Chapter 7—and then the balance of the fees are paid to us by the Bankruptcy Court, out of the payments you make in your Chapter 13 plan.
